1. Introduction
Welcome to Arway (“Arway,” “we,” “our,” or “us”), operated by:

Arway provides AI-powered photo enhancement tools designed for real estate agents, brokers, and agencies (“Users”). By accessing or using the Arway platform, website, or services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Services.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use Arway.
3. Account Registration
You agree to:
- Provide accurate and complete registration information
- Keep your login credentials secure
- Accept responsibility for all activity under your account
Arway may suspend or terminate accounts for violations of these Terms.
4. Services Description
Arway provides AI-powered image enhancement tools for real estate marketing, including but not limited to:
- Photo enhancement and optimization
- Upscaling and resolution improvement
- Lighting, clarity, and color adjustments
- Creating videos through artificial intelligence video models
All outputs are generated automatically and may vary in quality.
5. User Content & Rights
5.1 Ownership
You retain full ownership of any photos or content you upload (“User Content”).
5.2 License to Arway
You grant Arway a limited, non-exclusive, royalty-free license to process, modify, and store your User Content solely for the purpose of providing the Services.
5.3 Responsibility
You represent that you have all necessary rights and permissions to upload and process the content.
6. AI Output Disclaimer
AI-generated outputs:
- Are provided “as is”
- May contain errors or inaccuracies
- Should be reviewed before commercial or MLS use
Arway does not guarantee legal, regulatory, or listing compliance.
7. Prohibited Use
You may not:
- Upload illegal, harmful, or infringing content
- Attempt to reverse engineer or misuse the platform
- Circumvent security or usage limitations
8. Fees & Billing
Paid features are governed by the Payment & Billing Policy. Prices may change with prior notice.
9. Termination
Arway may suspend or terminate your account at any time for violations of these Terms or misuse of the Services.
10. Limitation of Liability
To the maximum extent permitted by law:
- Arway shall not be liable for indirect or consequential damages
- Total liability shall not exceed the amount paid by you to Arway in the previous 12 months
11. Indemnification
You agree to indemnify and hold harmless Wild Horses s.r.o. from claims arising from:
- Your use of the Services
- Your uploaded content
- Breach of these Terms
12. Governing Law
These Terms are governed by the laws of the Slovak Republic, without regard to conflict-of-law principles.
